Welcome to MotuArt, a mobile and web-based AI photography service. These terms of service are entered into by and between You and LANMOON PTE. LTD. ("Company," "We," or "us"), incorporated in Singapore. The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, "Terms of Service" or "TOS"), govern your access to and use of www.motu.art (the "Website"), and the MotuArt iOS and Android mobile application (the "App"), whether as a guest or a registered user.

1. Acceptance of Terms

By accessing, downloading, or using the Website and/or App, you accept and agree to be bound by these Terms of Service and our Privacy Policy (available at www.motu.art). If you do not agree, you must not use the Website or App.

2. Description of Services

  • MotuArt is an AI photography service that allows users to upload selfies to generate personal headshots, team photos, group photos, and more.
  • AI Technology: MotuArt uses Generative AI algorithms. We restrict inappropriate use (e.g., nudity, non-consensual photos) but cannot guarantee all content will align with your expectations. Report concerns via Section 14.
  • Data Usage: MotuArt does not use your personal data to train third-party AI/products.

3. Minimum Age Requirement

Services are not intended for users under 18. Users under 18 are prohibited from accessing MotuArt. Any party permitting minors to use MotuArt will be in breach of these TOS and may have access revoked.

4. User Accounts

  • You must provide accurate, current, and complete registration details.
  • You agree to:
    • Maintain confidentiality of login credentials.
    • Notify us immediately of unauthorized access.
    • Exit your account after each session.
  • We may disable accounts at our discretion for violations of these TOS.

5. Right to Amend

  • We reserve the right to modify, suspend, or discontinue the Website/App or any features.
  • Restrict access to parts of the service at any time.
  • You are responsible for ensuring compliance by all users accessing MotuArt through your connection.

6. Intellectual Property Rights

  • The Website, App, and all content (text, images, software, etc.) are owned by LANMOON or its licensors and protected under Singaporean and international intellectual property laws.
  • You may:
    • Temporarily store materials for access.
    • Cache files for display enhancement.
    • Print/download reasonable pages for personal use.
  • You may not:
    • Reproduce, distribute, modify, or create derivative works.
    • Use content for commercial purposes.
  • All rights not expressly granted are reserved by LANMOON.

7. Trademarks

"LANMOON," "MotuArt," and related logos are trademarks of LANMOON. Third-party trademarks on the Website belong to their respective owners.

8. Prohibited Uses

  • Violate laws, exploit minors, harass others, or send spam.
  • Impersonate any person/entity.
  • Disrupt the service (e.g., viruses, denial-of-service attacks).
  • Use photos of third parties without consent.
  • Engage in discrimination, illegal activities, or automated decision-making affecting legal rights.

9. User Contributions

Content you post or generate ("User Contributions") must comply with Section 13 (Content Standards). By posting, you grant LANMOON a non-exclusive, worldwide license to use, modify, and distribute such content. You warrant that you own all rights to your User Contributions.

10. Monitoring & Enforcement

  • We may remove User Contributions at our discretion.
  • Disclose your identity to third parties claiming infringement.
  • Terminate access for violations.
  • Cooperate with law enforcement.
  • We assume no liability for user-generated content.

11. Fees & Payment

  • Fees for services will be specified at purchase.
  • Payment processed via Stripe: under their terms.
  • Fees are non-refundable unless required by Singapore law.
  • You are responsible for applicable taxes.

12. Copyright Infringement

To report infringement, contact us at alex.yuan@lanmoontech.com with:

  • Your signature and contact details.
  • Identification of infringed work(s).
  • A statement of good faith belief.

13. Content Standards

  • User Contributions must not contain defamatory, abusive, or illegal material.
  • Promote violence, discrimination, or fraud.
  • Infringe intellectual property or privacy rights.
  • Impersonate others or involve unauthorized commercial activities.

14. Disclaimer of Warranties

MotuArt is provided "as is." We disclaim all warranties (express/implied), including accuracy, reliability, or virus-free operation. Use at your own risk.

15. Limitation of Liability

LANMOON, its affiliates, and licensors shall not be liable for any damages (direct, indirect, or consequential) arising from your use of MotuArt. Liability is capped at fees paid in the 12 months preceding a claim.

16. Indemnification

You agree to indemnify LANMOON against claims arising from your breach of these TOS or misuse of MotuArt.

17. Governing Law & Jurisdiction

  • Governing Law: Singapore law, excluding conflict-of-law principles.
  • Jurisdiction: Exclusive jurisdiction of Singapore courts.

18. Miscellaneous

  • Waiver: No waiver of any term is effective unless in writing.
  • Severability: If any provision is invalid, the remainder remains enforceable.
  • Amendments: Revised TOS apply immediately upon posting. Continued use = acceptance.
  • Entire Agreement: These TOS + Privacy Policy constitute the full agreement.
